On a slight incline you should not need to use the parking brake. plus the fact that it goes into neutral on its own
apparently Mercedes knows this because they have a disclaimer in the manual.

Car was in park , NOT neutral .sitting in car when it rolled after 15 min or so.yet it shows P.According to the warning on that page it sounds like you put the car in Neutral (N) instead of Park (P ) when you shut off your car. Are you sure put push the button at the tip of the shift lever to put it in Park rather than moving the lever up or down to put it in Neutral? Because it says if you put it in park the brake is automatically engaged.

I also think it is a defect but do I want to waste my time with the hard headed dealer.or just apply parking brake. I already took the car in twice both times could not duplicate. The explanation I was given is this is like a "hybrid transmissionSomethings not right, I would take to the dealer and have them show you others that roll back even in P mode. I can see how it can be taken as it will switch to N when turned off but I don't think it's the case. At least not when it's already on P mode. The part about the P-Brake is disclaimer found in all manuals for safety reasons. Kinda like always make sure to wear goggles when using power tools.
